Pasillo Terms of Use
Effective: October 21, 2026
The short version
Pasillo is the mall guide on your phone. It is operated by Zentoko AI, LLC. These terms are the agreement between you and us. What matters most:
- The guide is free for shoppers and needs no account.
- Each store's information is kept up to date by the store and the mall. We do our best to get it right, but it may contain errors. Routes are approximate.
- Each deal belongs to the store that publishes it. The store, not Pasillo, must honor it on the terms announced.
- Shoppers can leave tips about stores, made from phrases on a list. Each tip is a shopper's opinion, not the store's or Pasillo's.
- "Sponsored" means the store paid for a plan or for a promotion's visibility. Every deal carries that label.
- Store and mall accounts are by invitation. Look after your password and publish only true information.
- Each mall sets the price of the plans and of Antojo, and of Boost and Spotlight promotions if it charges for them, and bills the store on its monthly statement for the days it had each one.
- We may hide content or suspend accounts that don't follow these rules. The mall can delete a store.
- If you are a consumer, your rights under Panamanian law don't change. For stores and malls, our liability has limits.
- If there's a problem, let's talk first. The laws of Panama apply.
Questions about these terms: info@pasillomall.com.
1. Who we are and how to reach us
In short: Pasillo is operated by Zentoko AI, LLC. Email is the fastest way to reach us.
Pasillo is operated by Zentoko AI, LLC, a Georgia (United States) limited liability company based in Atlanta ("Pasillo", "we").
These terms cover everything we call Pasillo: the pasillomall.com website, the app at app.pasillomall.com (the shopper guide, each store's page, the store portal, the mall portal and the Pasillo staff tools), our emails and our WhatsApp notices.
Write to us at info@pasillomall.com, including for legal notices. By post: Zentoko AI, LLC, 2625 Piedmont Road, Ste. 56-400, Atlanta, Georgia 30324, United States.
2. Agreeing to these terms
In short: if you use Pasillo, you accept these terms. The Privacy Policy explains what we do with data.
If you have an account, you accept these terms when you create it from your invitation, where we show them to you. If you use the guide without an account, you accept them by using it. If you don't agree, don't use Pasillo.
Our Privacy Policy explains what data we keep, why, and your rights. Some features show their own rules where you use them, such as each plan's limits under "Plan & billing". Those rules are part of these terms.
If a mall signed a contract with Pasillo, that contract prevails over these terms in what it covers for that mall.
If you use Pasillo on behalf of a store or a mall, you accept these terms on its behalf and confirm that you may do so, except as section 6 says about cashiers.
3. What Pasillo is
In short: a guide for finding stores inside the mall, with portals so stores and the mall keep it up to date.
Pasillo helps you find stores in a large mall by the zone and floor you are on. It has:
- The shopper guide: search, nearby stores, a floor plan with routes, QR codes around the mall, sign scanning, deals, email deal alerts, shopper tips and "Report a problem".
- Each store's page, which can be shared.
- The store portal, where managers keep the listing up to date, publish promotions and choose the plan, and the store's cashiers record redemptions.
- The mall portal, where the mall team keeps the directory and the floor plan up to date, approves promotions, invites stores and sees reports.
- The Pasillo staff tools, for our staff only.
Pasillo is an independent product. Each mall and each store is a separate company. A mall or store appearing in Pasillo doesn't mean it endorses us. Pasillo is not affiliated with or endorsed by any mall, Albrook Mall included, except a mall that has signed a contract with Pasillo.
4. Using the guide as a shopper
In short: the guide is free. Use it with care, check what matters in the mall and leave only true tips.
Free and without an account. You can use the guide without paying and without creating an account.
The information may contain errors. Stores and the mall keep each listing's details up to date: zone, floor, unit, hours, contacts and photos. Some details come from the mall's public sources. They may be out of date or wrong. Routes on the plan are approximate, and some map points, such as escalators, may not have been checked on site. Before you walk far, check the mall's signs. If you see a mistake, use "Report a problem".
Your safety first. Watch where you walk. Don't use your phone while going up or down escalators. Pasillo is not an emergency system: in an emergency, follow the instructions of mall staff and the authorities.
Sign scanning. Scanning uses artificial intelligence and may get it wrong or not recognize the store. Check the result. Aim only at the store's sign.
Deal alerts. Alerts are advertising emails with the stores' new deals. You can ask for them if you are 18 or over. Use only your own email.
Reporting a problem. Report only what you saw. The mall decides what to do with each report.
Tips for other shoppers. You can leave a tip about a store in the mall, without an account. You make it by picking a store and a phrase from a list Pasillo writes, for example "Great coffee at this store" or "Ask for the combo". You can't type your own text. You can leave up to 3 tips a day at each mall, and one per store.
Rules for tips. Leave only tips that are:
- true, about something you experienced at that store;
- about the store you picked, not another one;
- your own: nobody paid you or gave you anything for them.
Don't leave tips about the store you work at, a store that belongs to you or your family, or its competitors (section 11).
Where they show. Tips show to everyone who uses that mall's guide: on the store's card and on the 3D map, where one of the decoration shoppers walking the halls says it in a bubble as it passes your character. That figure is decoration: it is not the person who left the tip. Nobody sees who left a tip, and Pasillo never shows where another shopper is or whether they are in the mall. A tip shows without a person reviewing it first, because it only uses phrases from the list. It may show with the phrase in the reader's language. It is deleted after 90 days.
A tip is not an endorsement or an offer. Each tip is a shopper's opinion. It is not the opinion of the store, the mall or Pasillo, and it doesn't mean they endorse it or have checked it. Pasillo writes the phrases on the list, but the shopper picks the phrase and the store. A tip is not an offer either: the store must honor only the deals it publishes itself (section 5). Tips are not paid for: no store can pay to get more tips or to have them shown more, and that is why they don't carry the "Sponsored" label.
Your permission for us to show it. When you leave a tip, you give Zentoko AI, LLC a non-exclusive, free, worldwide permission to store, copy, show with the phrase in another language and distribute it so that Pasillo works: in the guide, on the 3D map, in the copies for use without signal and in the store's and the mall's portals. Our providers may do the same only so that Pasillo works. This permission ends when the tip is deleted, except for copies that remain in backups or on shoppers' phones until they are refreshed.
Removing and reporting. The store can hide a tip about itself, and the mall and Pasillo can remove any tip (sections 7 and 12). Anyone can report a tip with "Report" on the store's card. Because we don't keep who left each tip, we can't find yours to delete them: you can report them, and they are deleted on their own after 90 days.
Photos with your character. You can make a photo with your character on your phone, with the camera or a photo you pick, and share it. We never receive it (Privacy Policy, section 2). You are responsible for the photos you take and share: ask before you photograph other people, don't share photos of children without their parents' permission, follow the mall's and each store's photo rules, and the rules of the apps you share them in. The picture carries Pasillo's logo and the mall's address, and may show a store's logo, for example on your character's bag. A mall may switch these photos off.
Treasure hunts. A mall can run a treasure hunt in the app: clues that lead you to scan the QR code at a store's register or find a star on the 3D map. Taking part is free and needs no purchase. Your progress stays on your phone (Privacy Policy, section 2).
Hunt prizes. A hunt may have a prize: what one store of the mall gives everyone who finishes it. There is no draw, no limited number and no prize only for the first ones. The prize is never alcohol, tobacco or anything for adults only. It may have conditions (for example, "on purchases from $20"), it is one per person and it can't be exchanged for cash. The official rules show in the app with each hunt: who runs it (the mall and the store that gives the prize), who can take part, the dates, the prize, how to claim it and until when. When you finish, tap "Get my code": the app asks Pasillo for a random one-time code (for example, "PZ-7KQ3MD") and keeps it on your phone. Show it at that store's register: it works once, until the prize's last day, which runs from the hunt's last day to at most 30 days after it. If the mall stops the hunt, codes already given keep working until their last day. The store that gives the prize must honor it with its conditions, and the mall runs the hunt and writes its rules. Pasillo only provides the app: it doesn't run or sponsor hunts and gives no prizes. At a mall that isn't published yet, the code is a sample: it isn't kept and doesn't work at any store.
Other services. The WhatsApp, phone, website and Instagram buttons take you outside Pasillo. What happens there is between you and the store, and those services' rules apply.
5. Deals and promotions
In short: the store publishes each deal and must honor it. Pasillo only shows it.
In these terms, "deal" and "promotion" mean the same thing.
Who makes the offer. Each deal is published by a store, which sets the discount, the conditions, the code and the dates. Under Panamanian law, the store that publishes an offer must honor it on the terms announced. Your purchase is an agreement between you and the store. The store, not Pasillo or the mall, is responsible for honoring the deal and for the products, prices, stock, warranties and returns.
The mall's review. Normally, the mall reviews each promotion before it is published. The mall may choose to publish them without review. A published deal doesn't mean that Pasillo or the mall guarantees it.
How to use a deal. Show the code at the register before you pay. The store types it in to record it. The code is not a personal coupon: every shopper uses it. It is valid only on the dates shown (calendar days in the mall's time) and under the deal's conditions. If a deal shows no conditions, it applies without conditions during its dates.
"Sponsored". Every deal comes from a store with a paid plan, which is why the Deals tab and each deal carry the "Sponsored" label ("Patrocinado" in Spanish). Stores can also choose more visibility for a promotion (section 8): those deals show first in the Deals tab, with a larger card, and one of them can show first on "Nearby". A store with a paid plan may also show first in some searches. On "Nearby" and in search there is at most one sponsored result per screen, and it always carries the label. Your phone picks those results from the zone you chose, or in turn among the mall's Spotlight deals, without using your personal data.
"Example". Deals labeled "Example" are demonstrations. They are not valid at any store.
If something goes wrong. Talk to the store first. You can also tell the mall or write to us. We may hide a deal that isn't honored. Your consumer rights under Panamanian law, including going to the Consumer Protection and Competition Defense Authority (ACODECO), don't change.
6. Store and mall accounts
In short: accounts are by invitation, they are personal, and you must look after them.
Who can have an account. Only invited people. The mall team invites each store's managers, and managers can invite their colleagues. The Pasillo team or mall colleagues invite the mall team. You must be 18 or over and be authorized by the store or mall.
Roles in a store. A manager keeps the listing up to date, publishes promotions, chooses the plan, sees the store's numbers and invites colleagues as managers or cashiers. A cashier only checks and records promotion codes at the register. Every store keeps at least one manager. If you invite someone, they must work for the store; remove their access when they stop. Managers accept these terms on the store's behalf; cashiers accept them only for their own use.
One account per person. Each person uses their own account. Don't share your access. One account can work at several stores.
Look after your access. Use a password of at least 8 characters that you don't use on any other site. You are responsible for what is done with your account. We'll email you if your password changes or you are signed out on every device. If it wasn't you, or you think someone else got in, change your password, use "Sign out everywhere" in Account and write to us.
Your email. Your email is your username. To change it, ask for a new invitation.
When access ends. A manager or the mall can remove your access to a store, and the mall can remove you from its team, for example if you stop working there. If you no longer have access to any store or mall, your account is disabled and you are signed out.
7. Store listings, photos and content
In short: publish only true information and photos you may use. You give us permission to show them in Pasillo.
What you can publish. Description, hours, WhatsApp, phone, website, Instagram, your logo and photos: one main photo and up to 5 more, in JPG, PNG or WebP of up to 3 MB each. When you upload a photo, our server removes its hidden data, such as where it was taken. Your logo shows on your store's listing and on the shopping bag that shoppers who scan your register's QR code carry in the 3D map.
Crowds on the 3D map. Outside each store, the 3D map shows a crowd of drawn shoppers in proportion to the interest shoppers showed in it over the last 7 days (its listing opened, directions, deal codes, WhatsApp and calls), in three levels, and only from 3 different phones. Every shopper and every store can see it. It never depends on your plan or your promotions, and it can't be bought.
What the mall sets. The mall sets each store's name, zone, floor and category. To change them, use "Request a change" on My listing. The mall can also correct your listing and remove photos.
Rules for your content. What you publish must:
- be true, up to date and not misleading;
- be yours or used with permission, including brands, logos and photos;
- comply with the law, including Law 45 of 2007 on consumer protection;
- not show recognizable people without their permission;
- not include other people's personal data; use business contacts;
- not be offensive, violent or sexual, or promote illegal products or activities.
Keep your listing up to date. Check your listing often and confirm its details when the portal asks you to. Some listings were created from the mall's public information. Correct it if anything is wrong.
Shopper tips about your store. Shoppers can leave tips about your store with phrases from a list (section 4). In "Tips", in the portal, managers see the tips about the store and can hide any of them. A hidden tip is no longer shown to shoppers, and you can show it again until it is deleted. If you think a tip is fake, report it to the mall. Neither you nor the people who work at the store may leave tips about it or its competitors, or ask for, pay for or offer discounts, gifts or anything else in exchange for tips (section 11). Tips are not your content and don't change what you must honor in your deals.
Your permission for us to show it. What you publish stays yours. You give Zentoko AI, LLC a non-exclusive, free, worldwide permission to store, copy, adjust the size and format of, show and distribute your content so that Pasillo works: in the guide, on your store's page, in previews of shared links, in search engines, in the copies for use without signal, in the mall's portal and reports, in deal-alert emails, and in the pictures shoppers make with the app and share (your logo on a character's bag, for example). Our providers may do the same only so that Pasillo works.
This permission ends when you remove the content or the listing is withdrawn, except for copies that remain in backups or on shoppers' phones until they are refreshed, copies other people have already shared, what we must keep for billing or by law, and deal-alert emails already sent.
We may also show screenshots of the app, with listings as they appear in it, in our presentations to malls. We won't use your store's photos or logo in an ad without asking you.
8. Store promotions
In short: your plan sets how many promotions you can have. The mall may review them, and you must honor them, like the treasure hunt prizes you accept.
Antojo for restaurants. A mall may give a restaurant the "Antojo" package: its café table on the 3D map in its color with its dish on the tray, and with "Antojo+" also shoppers' craving lines that name its dishes and running deals, and a card at mealtimes. Every one of them says "Sponsored". The restaurant writes its dishes, which must be true and on its menu, and the mall approves them. Up to 3 restaurants of one cuisine take equal turns. The package never changes the crowds outside stores. The mall sets a monthly price for Antojo and one for Antojo+, and bills the restaurant on its monthly statement by the day, for the days the package runs, like plans. The price is locked when the mall books the package, so a later change never changes a package already booked. The mall must tell restaurants at least 30 days before it starts charging for Antojo or raises its price (sections 9 and 10).
How many you can have. The Free plan includes no promotions. Featured allows 1 at a time and Premium up to 3 at a time. A promotion takes a slot while it is in review, scheduled or running.
Visibility. Each promotion has a visibility you choose when you create it:
- Basic: the Deals tab and your store's card, with the deal's badge.
- Boost: also your store's photo on the card, before Basic promotions in Deals, and it can show first on "Nearby" to shoppers up to two zones away.
- Spotlight: a larger card at the top of Deals; it can show first on "Nearby" anywhere in the mall and has the largest tag on the 3D map. A Spotlight promotion lasts at most 14 days, a store has one at a time, and the mall has a limited number of places at once (set by the mall); the portal tells you whether there is room on your dates.
Visibility doesn't guarantee visits, sales or a fixed position: when several promotions share a place, they take turns. Basic is always free. Boost and Spotlight are free unless your mall sets a price for them (section 9). While a visibility is free at your mall, we may change what it includes; once your mall charges for it, a change never reduces what it includes for a promotion you already sent. If the mall reduces its Spotlight places, promotions already published keep theirs until they end.
What it must have. A title, a code, start and end dates, and every condition that limits the offer, such as excluded products, a minimum purchase, a limit per customer or the units available. If you add no conditions, the offer applies without conditions during its dates. The dates are calendar days in the mall's time.
The mall's review. Normally, the mall reviews each promotion before publishing it, and approves or rejects it with a reason. You can edit it while it is in review. The mall may choose to publish without review and may withdraw a published promotion. The mall's approval doesn't make it responsible for the promotion.
Withdrawing. You can withdraw your promotion at any time. Shoppers stop seeing it as soon as their app refreshes; someone with a copy saved for use without signal may see it a while longer.
Honoring it. Under Law 45 of 2007, the offer you publish binds you on the terms announced. You must apply it during its dates and under its conditions, and follow the other rules for special sales, such as showing the previous price in the store. Record only real redemptions in "Redeem a code". Redemption counts are for information and are not proof of sales.
Plan changes. If you move to a plan with fewer promotions, you choose which ones to keep and the others are withdrawn. If the mall marks your unit as vacant, the store moves to the Free plan and all its promotions in review, scheduled or running are withdrawn.
Alerts to shoppers. People who follow your store get your new promotion in their next daily deals email, sent from 10 am mall time.
Treasure hunt prizes. The mall may ask your store to give the prize of one of its treasure hunts (section 4). The prize shows only once you accept it in "Prizes", in the portal; you can also decline it with a reason, which the mall sees. When you accept it, your store is the one giving the prize: you must give it to everyone who finishes the hunt and shows their code at your register, one per person, with the conditions shown, until the prize's last day. Each code works once: record it in "Redeem a code". The prize can never be alcohol, tobacco or anything for adults only, and taking part in the hunt needs no purchase. The mall writes the hunt's rules.
9. Plans and billing
In short: the mall sets the prices and charges you on its monthly statement for each plan and Antojo, and for Boost and Spotlight if it charges for them, for the days you had them.
The plans. There are three: Free, Featured and Premium. The portal, under "Plan & billing", shows what each includes and its price. In short:
- Free: a listing with zone, floor and hours; shows in search and on "Nearby"; WhatsApp, phone, photos and links; statistics and a monthly report.
- Featured: everything in Free; may show first, as "Sponsored", when shoppers search its category (one store per search); 1 promotion at a time; shoppers can follow its deals by email; its deal can show first on "Nearby" to shoppers up to two zones away.
- Premium: everything in Featured; up to 3 promotions at a time; its deal shows first under "In your zone" to shoppers in its zone.
A promotion with Boost or Spotlight visibility (section 8) shows first on "Nearby" before these plan placements.
Paid plans give more visibility, but they don't guarantee visits, sales or a fixed position.
Prices. Each mall sets the monthly prices of its plans. The Free plan always costs $0.
Who charges. The mall charges the store for the plan on its monthly statement, next to the rent. There is no other invoice. Pasillo doesn't charge stores directly or take card payments. Payment terms, taxes and complaints about a charge are settled between the store and the mall.
By the day. Each plan is billed for the days of the month you had it: the monthly price times the days on that plan, divided by the days in the month, rounded to the cent. Each day counts at the plan the store has at the end of that day, in the mall's time. A store counts from the day it was added to Pasillo until the day before it is deleted. This applies from October 2026; months closed before then were billed at the plan held on the month's last day.
Plan changes. You can change plans at any time, including going back to Free. The new plan counts from the day of the change and the old one is billed up to the day before. The charge appears on your next statement.
Price changes. The mall may change its prices. A new price counts from the day the mall changes it, in the mall's time; the earlier days of that month are billed at the old price. Months already closed don't change. The mall must tell you before raising a price (section 10), and Pasillo also emails the managers of every store on that plan when its price goes up.
Boost and Spotlight. Basic visibility is always free. The mall may set a price per day for Boost and one for Spotlight; until it does, they are free. If your mall charges for them:
- the portal shows the price on the promotion form, before you send the promotion;
- each day the promotion is published and running is billed, in the mall's time, at the price it had when you sent it: the price is locked when you send the promotion;
- days in review, scheduled before the start, after the end, after a rejection, and days when the mall is not published in Pasillo are not billed;
- if you withdraw the promotion, it is billed up to the day you withdraw it, that day included;
- if the mall withdraws it, the day it is withdrawn and the days after are not billed;
- there is no credit for short interruptions of the service (section 13);
- the charge appears on the same monthly statement as your plan, and payment, taxes and complaints are settled with the mall, as for plans.
The mall must tell stores at least 30 days before it starts charging for Boost or Spotlight or raises their price (section 10). A new price applies only to promotions sent after it; a later change never changes a promotion already sent.
Between the mall and Pasillo. The app sponsorship is billed to the mall by the whole month. Pasillo receives a fee on what the mall bills for plans, Boost, Spotlight, Antojo and sponsorship in Pasillo, under the mall's contract with Pasillo.
10. The mall team's responsibilities
In short: the mall keeps the directory and the floor plan up to date, decides on promotions, runs its treasure hunts and charges its stores.
If you are on a mall's team, you agree to:
- invite only people authorized by each store, and remove access from anyone who no longer is;
- keep the zones, floors, floor plans, map points and QR signs correct, and check the points on site;
- not change or delete a map point whose QR sign is printed, because the sign would stop working;
- review promotions and changes on fair criteria and give the reason when you reject;
- remove shopper tips only when they break the rules in section 4, with the same criteria for every store;
- set the prices, tell stores at least 30 days before raising a price or starting to charge for Boost, Spotlight or Antojo, and charge them what Pasillo's statement shows;
- run your treasure hunts and write their rules, and offer as a prize only what one store of the mall gives everyone who finishes: no draw, no limited number, no purchase to take part, and never alcohol, tobacco or anything for adults only; you may stop a hunt, and codes already given keep working until their last day;
- delete a store only when it is no longer in the mall, knowing that its managers and cashiers lose access;
- mark that a store agreed to WhatsApp notices only if it really agreed;
- use Pasillo's data (statistics, reports and store contacts) only to run the mall and its relationship with its stores, and in line with Law 81 of 2019;
- not try to identify shoppers;
- not share one store's statistics with another store.
11. Acceptable use
In short: use Pasillo honestly and don't harm it.
You may not:
- use Pasillo for anything illegal or to deceive other people;
- publish fake deals or listings, or pretend to be a store, a mall or a person;
- record redemptions that didn't happen;
- get into accounts or data that aren't yours, or try to get around access controls or limits;
- copy Pasillo's data in bulk or with automated programs, except search engines that respect our robots.txt file;
- send fake reports or activity to change the statistics;
- leave fake tips, tips about a store you work at or that belongs to you or your family, or tips about its competitors;
- ask for, pay for or offer discounts, gifts or anything else in exchange for tips;
- send tips with automated programs, get around the daily limit or report tips for no reason;
- attack, overload or interfere with Pasillo, or upload viruses or other harmful code;
- use sign scanning for photos that are not store signs;
- use photos with your character to mock, harass or deceive people, or to make it look as if a store or the mall endorses something it doesn't;
- resell Pasillo or give others access to it without our permission;
- take apart or copy Pasillo's software, except as the law allows.
12. Suspension, deletion and closing
In short: we may hide content or suspend accounts that break these rules. The mall can delete a store, and the Pasillo team can delete a mall nobody uses.
What Pasillo can do. We may hide or remove content, withdraw a deal, and suspend or close an account if these terms are broken, to protect people or Pasillo, if the law requires it, or if the relationship with a mall ends. When we can, we'll tell you why.
What the mall can do. The mall can remove a person's access, edit a listing, remove photos, withdraw a promotion, remove a shopper's tip or mark a unit as vacant. A vacant unit is no longer shown to shoppers, moves to the Free plan, and its promotions are withdrawn. A tip the mall or Pasillo removes is deleted.
Deleting a store. The mall team and the Pasillo team can delete a store, for example if it closed. It disappears from Pasillo, its promotions are withdrawn, its photos are deleted, the people who work there lose access to it and shoppers stop following it. Its managers get an email saying who deleted it and whether they still have access to Pasillo. The days of the month it was on a paid plan are still billed, up to the day before it was deleted.
Deleting a mall. The Pasillo team can delete a mall that isn't published and that nobody from its team has joined. Everything about the mall is deleted. A published mall can be hidden: it is no longer shown to the public and sends no deal alerts.
Asking us to delete your account. Write to info@pasillomall.com. We delete it within 30 days, except what we must keep by law.
You can leave. You can stop using Pasillo at any time.
If we stop offering Pasillo. We'll try to give at least 30 days' notice.
The parts of these terms that by their nature should continue after your use ends will continue, such as the permission over content already shared, the disclaimers, the limits on liability and the section on disputes.
13. Availability and use without signal
In short: Pasillo may fail or change, and without signal it may show old information.
We do our best to keep Pasillo working at all times, but there may be outages or maintenance. Some features may be off or limited, such as emails, WhatsApp notices or sign scanning, which has a daily limit.
After you open Pasillo with a connection, your phone keeps a copy to use where signal is weak. That copy may be out of date: a deal may have ended or hours may have changed. Check at the store.
We may add, change or remove features.
14. Intellectual property
In short: Pasillo is ours. Store and mall brands belong to their owners.
The Pasillo name, its logo, its design, its software and its text belong to Zentoko AI, LLC or to those who license them to us. We give you a personal, limited and revocable permission to use Pasillo under these terms. We give you no other right.
Store names, logos and brands belong to their owners. The mall's name and its floor plans belong to the mall. We show them only so you can identify the stores and the mall and find your way in it, and in the pictures shoppers make with the app; showing them doesn't mean their owners endorse Pasillo.
If you send us ideas or comments, we may use them with no obligation to you.
15. Content complaints
In short: if something on Pasillo violates your rights, write to us.
If you believe something published on Pasillo violates your copyright, your trademark or your privacy, or is illegal, write to info@pasillomall.com with the subject "Content removal". Include:
- the link or a clear description of the content;
- which right you believe it violates and why;
- your name and how to contact you;
- a statement that what you say is true and that you are acting in good faith.
We'll review your complaint and may remove the content and notify whoever published it.
For a shopper's tip, just tap "Report" on the store's card (section 4).
16. Disclaimers
In short: we do our best, but we offer Pasillo as it is.
Pasillo is offered "as is" and "as available". As far as the law allows, we give no warranties of any kind, express or implied. We don't guarantee that store information, hours, deals, shopper tips, routes or scan results are correct, or that Pasillo will work without interruptions or errors. We don't guarantee stores and malls visits, sales or results.
If you are a consumer, this section doesn't take away the rights that Panamanian law gives you and that can't be waived.
17. Limits on liability
In short: if you are a shopper, we are liable as Panamanian law provides. For stores and malls, our liability has a ceiling.
If you are a shopper. We are liable to you as Panamanian law provides. Nothing in this section limits our liability for harm to your person, for not delivering what we offer you, or for anything Law 45 of 2007 doesn't allow us to limit.
If you use Pasillo for a store or a mall. As far as the law allows: (a) we are not liable for indirect, special or consequential damages, or for lost profits, sales, data or reputation; (b) we are not liable for stores' deals, purchases or products, for treasure hunt prizes, or for the mall's charges; and (c) our total liability for any claim about Pasillo or these terms will not exceed what your store or mall was billed for Pasillo plans, paid visibility, Antojo and sponsorship in the 12 months before the event that caused the claim, or US$100, whichever is greater.
These limits don't apply to damages caused by our fraud (dolo) or gross negligence (culpa grave), or to anything the law doesn't allow us to limit.
18. Indemnity
In short: if a store or mall breaks these terms and someone makes a claim against us because of it, the store or mall covers the cost.
If you use Pasillo on behalf of a store or a mall, that store or mall will reimburse us for losses and reasonable costs, including reasonable lawyers' fees, arising from a claim by someone else about the content or promotions it published, about not honoring a deal, or about breaking these terms or the law. We'll tell you promptly about any such claim. This doesn't apply to the part of a claim that we caused, or to shoppers.
19. Governing law and disputes
In short: talk to us first. The laws of Panama apply, and if you are a consumer you keep every way to complain. There is no arbitration.
Talk to us first. We ask you to write to info@pasillomall.com before filing a claim, describing the problem and what you'd like us to do, and give us 30 days to try to resolve it. If you are a consumer, this step is optional and doesn't limit your right to go to ACODECO or a court.
Governing law. These terms are governed by the laws of the Republic of Panama.
Where disputes are resolved. Disputes are resolved before the competent courts of Panama. If you are a consumer, you can also use the courts and procedures of Law 45 of 2007.
Your consumer rights. Nothing in these terms takes away the rights that Panamanian law gives you as a consumer, including filing a complaint with ACODECO.
No arbitration. These terms don't require arbitration.
20. Changes to Pasillo and to these terms
In short: Pasillo will change over time, and we'll tell you before important changes to these terms.
We may change these terms. If a change is important, for example if it reduces your rights or gives you new obligations, we'll notify people with an account or deal alerts by email, and in the app, at least 30 days before it takes effect. Changes required by law, or needed for security or abuse, may apply sooner. A change never applies to a dispute that started before it. The change log is at the end of this page.
If you have an account, we'll ask you to accept the new terms the next time you sign in. If you use the guide without an account, you can stop using it at any time, at no cost.
21. General terms
In short: the usual rules about how these terms work.
- Whole agreement. These terms, the rules that features show and, for a mall, its contract with Pasillo, are the whole agreement about Pasillo.
- Notices. We may send you notices by email or in the app. You can send them to info@pasillomall.com or by post to the address in section 1. Electronic agreements, notices and records count as written.
- Transfer. You can't transfer your rights under these terms. We may transfer ours in a merger, an acquisition or a sale, and we'll let you know.
- If a part isn't valid, the rest still applies, and that part applies as far as the law allows.
- No waiver. If we don't enforce a part of these terms, we don't give up the right to enforce it later.
- Events beyond our control. We are not liable for delays or failures caused by events beyond our reasonable control, such as our providers' outages, natural disasters or power cuts.
- No third-party rights. These terms give rights to no one but you and us.
- Relationship. These terms don't make us partners, employer and employee, or agents of each other.
- Languages. These terms are in Spanish and English. If they differ, the Spanish version prevails.
- Headings and summaries. Headings and summaries help you read; what counts is each section's full text. "Including" means "including without limitation".
